Control mark - do not muddle up with a trademark

Control mark - a special mark certifying compliance with copyright and / or related rights and granting the right to distribute copies of audiovisual works, Phonograms, Videograms, computer programs, databases. The control mark is a single-use self-adhesive mark, the outer side of which has special holographic protection.

Distribution on the territory of Ukraine of copies of audiovisual works, Phonograms, Videograms, computer programs and databases, as well as their rental, is allowed only if they are marked with control marks.

The procedure for obtaining control stamps is determined by the law of Ukraine "on distribution of copies of audiovisual works, Phonograms, Videograms, computer programs, databases" No. 1587-III of 23.03.2000.

Importers, exporters, and reproducers of copies of audiovisual works, Phonograms, Videograms, computer programs, and databases have the right to receive control stamps.

To obtain control stamps, applicants submit the necessary package of documents to the Ministry of economic development, trade and agriculture and pay a fee of one percent of the non – taxable minimum income of citizens-UAH 0.17 for each control stamp.

Control stamps may be refused in the following cases:

  • submission by the applicant of an incomplete list of documents provided for by law;
  • submission by the applicant of documents for obtaining control stamps, the registration of which does not meet the requirements of the law;
  • submission by the applicant of documents for obtaining control stamps containing false information;
  • the applicant's failure to comply with the rights of copyright subjects and / or related rights.

Each control stamp has its own series and number.

Each control stamp is marked with information that identifies it with the corresponding copy of an audiovisual work, Phonogram, Videogram, computer program, or database.
